Proposals to introduce new IR35 rules for personal service companies (PSCs) in the public sector would, if introduced, shift responsibility for determining whether IR35 rules apply to a contract from PSCs to the organisations that pay them.

According to Qdos, a firm providing services to contractors, IR35 rules are almost certain to apply if organisations are obliged to use working required by HMRC when assessing public sector contracts.
